Khairlaji: Court proceedings on 30th June’08


The court assembles at 11:15 A.M. The discussions  going on mistakes that creeped in the typed depositions of the court. After that special public prosecutor Adv.Ujwal Nikam seeks for the adjournment of the court since he is engaged in the case of extradition of Abu Salem going on day to day basis.
Adv.Nikam: Sir, I will reques the court to adjourn the court for 4 weeks i.e. upto 28th July.
Judge: But we are to hear the case on day to basis.
Adv.Nikam: But sir it is perfectly allowed for the prosecution to seek for the adjournment for arguement .
Judge: Memorandum and circular says that the arguement must begin as early as possible.
Adv.Nikam: Circulars and memorandum do not have legal sanctions. Those are only directives.
Judge: But instead of finishing the arguements at one go , you can carry it out on peacemeal basis.
Adv.Nikam: But it  will be not prudent for me . Moreover your honour had taken a lot of time to record the statements of the accused.
Judge: But I had not wasted a single day.
Adv.Nikam: I know that sir. But I am asking for reasonable time.
Judge:   No. you are asking for unreasonable time. What the defence have to say about this?
 (Prodded by the Hon.Judge, the defence lawyer, Adv.Khandewale rises to speak)
Adv.Khandewale: My cocern whether such a long period of time is necessary for arguements ? But if the prosecution is facing the problem , then we can concede to adjourn for the same time.
Adv.Nikam: Sir, if I have to assist the court sincerly to arrive at justice , then that much time must be allowed for preparing for the arguements.
Judge: But you are asking for extended period of time.
Adv.Nikam: But I have to explain everything , like what facts interprete what !
Judge: But we have already run out of time. There is unrest within the people for the delay in the verdict.
Adv.Nikam: Sir, we are not to think of the people but the justice.
Judge: O.K. I will adjourn the court for 2 weeks till till 14th July.
Adv.Nikam: No sir , give us  at least the date of 24th or 25th july.
Judge: I can not adjourn for more than 3 weeks i.e.till 21st July  .
Adv.Nikam : All right sir. We are ready for it.
(The court is adjourned till 21st July for arguements)
